Indiana Brownfields Recovery Act

On August 4, 2009, the U.S. EPA awarded the Indiana Brownfields Program $2,500,000 in Brownfields Recovery Act revolving loan funds for cleanup of brownfield sites, $900,000 to address hazardous substances and $1.6 million for petroleum contamination. Funds will be used to replenish the Program’s revolving loan fund, from which the Program will provide loans and sub-grants to support cleanup activities at several of the 31 shovel-ready sites identified by municipalities in the State that are contaminated with hazardous substances and/or petroleum.

The environmental due diligence industry is in an unprecedented period of transition. The market barely had time to read EPA’s final All Appropriate Inquiries rule (40 CFR Part 312) released on November 1, 2005, when they were hit with another significant development two weeks later: a revised ASTM Phase I E 1527 standard. The federal rule, which recognizes the E 1527-05 standard as an acceptable guidance document for satisfying AAI and took effect on November 1, 2006, gave Phase I consultants less than one year to familiarize themselves with the new requirements. The attached Executive Summary, based on EDR’s 2005/2006 Due Diligence at Dawn workshop series, covers the fundamentals of meeting the new federal pre-transaction requirements, and the details of CERCLA’s post transaction continuing obligations.

Summary Of Work – The Indiana Finance Authority (IFA) and the Indiana Brownfields Program (Program), on behalf of the Indiana Department of Environmental Management (IDEM), will use the LUST Recovery Act money to perform site assessments and remedial actions at petroleum-contaminated sites throughout the state.

The 25 proposed shovel-ready sites throughout Indiana have been identified as orphaned or abandoned sites that are eligible for ARRA funding but for which adequate funding is not available to conduct assessment or clean-up. Some sites may be removed from the list and others added as the site assessment activities are completed. As of September 21, 2009, site work is underway at 14 sites with a total projected cost of $1.46 million. An estimated 36 USTs will be removed in order to undertake site cleanup, which will include the excavation of 11,200 tons of contaminated soil, resulting in the cleanup of 6.56 acres of property.

On July 16, 2009, the U.S. EPA awarded the State of Indiana $4,039,000 in LUST Recovery Act funds. Work is underway at 14 sites approved by the Program for LUST ARRA funding using consulting firms qualified by the IFA in May 2009. Work on these 14 sites is estimated to cost $1.46 million, and result in the removal of 36 underground storage tanks and 11,200 tons of contaminated soil, making 6.56 acres ready for redevelopment.
